Terms of Service

1. Acceptance of Terms
By accessing or using the Carewix platform ("Service") operated by Carewix Inc. ("Carewix", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users including staffing agencies, healthcare workers, and healthcare facility users.
2. Description of Service
Carewix provides a cloud-based healthcare staffing management platform that enables staffing agencies to manage workers, credentials, shift scheduling, and facility relationships. Healthcare workers may use the platform to manage their professional profiles and apply to shifts. Healthcare facilities may access the platform through their affiliated staffing agency.
3. Accounts & Registration
You must create an account to use the Service. You are responsible for: • Providing accurate, complete registration information • Maintaining the security of your account credentials • All activity that occurs under your account • Notifying us immediately of any unauthorized access Carewix reserves the right to suspend or terminate accounts that violate these terms.
4. Subscriptions & Billing
Agency subscriptions are billed monthly in advance. Pricing is as stated on our pricing page at the time of subscription. • Free trials last 14 days. No credit card is required during the trial period. • After the trial, a valid payment method is required to continue service. • Subscriptions renew automatically unless cancelled before the renewal date. • Refunds are not provided for partial billing periods. • We reserve the right to change pricing with 30 days' notice.
5. Acceptable Use
You agree not to use Carewix to: • Violate any applicable law or regulation • Post false or misleading credentials or information • Harass, abuse, or harm any other user • Attempt to gain unauthorized access to the platform or other users' data • Use the platform to facilitate illegal discrimination in hiring • Reverse engineer, decompile, or copy the platform Carewix may suspend or terminate your account for violations of this section without notice.
6. Healthcare Compliance
Carewix provides tools to assist with credential tracking and compliance documentation, but you are solely responsible for ensuring that workers placed through your agency meet all applicable regulatory requirements. Carewix does not guarantee the accuracy of worker-submitted credentials and is not liable for any regulatory violations arising from your agency's hiring decisions.
7. Intellectual Property
All content, features, and functionality of the Carewix platform — including software, design, text, and graphics — are owned by Carewix Inc. and protected by intellectual property laws. You retain ownership of any data you upload to the platform. By uploading data, you grant Carewix a limited license to process that data as necessary to provide the Service.
8. Data & Privacy
Our collection and use of personal information is governed by our Privacy Policy, incorporated herein by reference. For customers processing Protected Health Information (PHI), a Business Associate Agreement (BAA) must be executed before using the platform for such purposes.
9. Limitation of Liability
To the maximum extent permitted by law, Carewix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our aggregate liability for any claim arising from these terms shall not exceed the amount you paid to Carewix in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or secure. We make no guarantees regarding shift fill rates, worker performance, or regulatory outcomes.
11. Termination
You may cancel your subscription at any time. Upon cancellation, your account will remain active until the end of the current billing period. Carewix may terminate your account for violations of these terms or for any business reason with 30 days' notice.
12. Governing Law
These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
13. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or platform notice at least 14 days before they take effect. Continued use of the Service constitutes acceptance of the updated terms.
